VITAL PROTEINS SUBSCRIPTION PROGRAM – TERMS & CONDITIONS
Nestlé HealthCare Nutrition, Inc. dba Vital Proteins (“Vital Proteins,” “us,” “we,” or “our”) is pleased to offer an automatically recurring subscription ordering program (“Subscription Program”) for Vital Proteins products purchased through vitalproteins.mom (“Website”). The following terms and conditions (“Terms”), together with any additional applicable terms and conditions related to any promotional offers provided to you for use with the Subscription Program, constitute the entire agreement between you and Vital Proteins relating to the Subscription Program. When you choose to enroll in the Subscription Program by selecting the Subscribe & Save option when placing an order for any product on the Website, the following Terms apply. By selecting the Subscribe & Save option and placing an order through our Subscription Program, you acknowledge and accept these terms, conditions, limitations, and requirements. Please read these Terms carefully.
Please note that your use of the Website is also governed by other terms and conditions, including our Terms and Conditions and Privacy Policy, as well as all other applicable terms, conditions, limitations, and requirements on the Website, all of which (as updated from time to time) are incorporated into these Terms.
Automatic Renewal
Our Subscription Program is an automatic, recurring subscription service that begins as soon as your initial payment is processed. Your subscription will automatically renew and you will continue to be charged on a recurring basis according to the delivery frequency you select (i.e., 1, 2, 3, 4, 5, 6, 7, or 8 weeks) and without notice until you cancel. When you purchase a product and enroll in the Subscription Program, you acknowledge that you are signing up for continuous shipments of such product in the quantities and at the delivery frequency you choose, and you agree to be billed on a recurring, per-order basis until you cancel. You authorize Vital Proteins or its third-party payment processing provider(s) to store your payment method(s) and to automatically charge your payment method(s) based on the delivery frequency you select until you cancel.
We will automatically charge you the total, then-current price of the item(s) in your subscription order on the date that order is processed, less the Subscription Program discount (i.e., 15% off subscription order), plus any applicable sales taxes and shipping fees, each delivery frequency period until you cancel. YOU ACKNOWLEDGE AND AGREE THAT VITAL PROTEINS WILL NOT OBTAIN ANY ADDITIONAL AUTHORIZATION FROM YOU FOR SUCH AUTOMATIC, RECURRING PAYMENTS.
We may change the price of a product in your subscription order at any time, and we will notify you of any price change with the option to cancel. If you do not agree with a price change, you have the right to reject the change by cancelling your subscription as described in the “Cancellation Policy” section below. Please make sure that you read any notifications of price changes carefully.
The charge for each shipment will be billed to the primary payment method used to create your subscription order or as otherwise provided by you. If your payment method fails, your subscription order will be automatically cancelled and you will need to call us at 1-224-544-9110 (Monday - Friday, 9AM - 5PM CST) to reactivate your subscription. Once your subscription is reactivated you will then be able to update your payment information. You can update or edit your payment information anytime via the “Subscriptions” tab in your online Account.
Offer is valid only for individual purchasers. Products are not intended for resale. Offer not valid with any other offer, e-Gift Cards or wholesale orders, and may not be used in combination with third-party loyalty, reward, or cash-back programs. New products & special releases may be excluded as well as the following, but not limited to: new releases, limited edition/exclusive items, gifts/kits/sets, eGift Cards, items noted as not eligible, or items that are not in stock at the time of purchase. Cannot be applied to previously placed or pending orders. Valid in continental U.S. only.
Cancellation Policy
YOUR SUBSCRIPTION WILL AUTOMATICALLY RENEW UNTIL YOU CANCEL. YOU CAN CANCEL YOUR SUBSCRIPTION BY LOGGING INTO YOUR ACCOUNT, NAVIGATING TO THE “SUBSCRIPTIONS” TAB, SELECTING THE ACTIVE SUBSCRIPTION YOU WOULD LIKE TO CANCEL, AND CLICKING “CANCEL SUBSCRIPTION” AT THE BOTTOM OF THE SCREEN. YOU MAY ALSO CONTACT US AT 1-224-544-9110 (MONDAY – FRIDAY, 9 AM-5 PM CST).
TO AVOID CHARGES FOR AN UPCOMING SHIPMENT, YOU MUST CANCEL WITH AT LEAST THREE (3) DAYS’ NOTICE PRIOR TO THE NEXT “ORDER DATE” TO RECEIVE A FULL REFUND. SHOULD YOU CANCEL AFTER THAT TIME FRAME, THE PAYMENT FOR YOUR UPCOMING SUBSCRIPTION ORDER IS NON REFUNDABLE, AND YOUR SUBSCRIPTION WILL CONTINUE UNTIL THE END OF THAT DELIVERY FREQUENCY PERIOD.
Please note, you will be notified via email three (3) days prior to your next scheduled “Order Date” of upcoming charges for your subscription order. You can visit your member portal to update future subscription orders.
In the event you cancel your subscription, please note that we may still send you promotional communications about Vital Proteins, unless you opt out of receiving those communications by following the unsubscribe instructions provided therein.
We may, in our sole discretion, cancel all or part of your subscription order at any time for any reason, in our discretion. If we do so, you will only be charged for orders that have been shipped to you. We may also limit the number of products in your subscription order. In the event we determine, in our sole discretion, that you have engaged in abuse of our subscription program, your Account may be suspended. We reserve the right, at our sole discretion, to modify or make changes to these Terms at any time. If any change to these Terms is found invalid, void, or for any reason unenforceable, that change is severable and does not affect the validity and enforceability of any remaining changes or conditions. YOUR CONTINUED PARTICIPATION AFTER MODIFICATION CONSTITUTES YOUR ACCEPTANCE OF THE CHANGES. IF YOU DO NOT AGREE TO ANY CHANGES, YOU MUST CANCEL YOUR SUBSCRIPTION.
